Legal Question in Civil Litigation in California

Notary Signatrure - Date of Signing and Plaintiff's Signature Questioned

Thanks for your quick response. **Re-ask**

What if the reason was to beat a statue of limitations problem they were facing and the signature of the plaintiff doesn't appear to match other known documents?

Does it matter? The suit has been filed. Will they simply do a new declaration (even though it is past the statute of limitations)?

***************************

Is it legal and proper for a Notary to add the date for a client after a client has left the building? (the client forget to put the date down)

DATED this ___ day of July, 2009

__(signed)__________

Client Name

Subscribed and sworn to me this __10th__ day of July, 2009

_____(signed)_________

Notary's Name

State of xxxxxx

My commission expires xx/xx/xx (NOTARY STAMP)

This is on a declaration for a lawsuit.

If you are saying there is attempted fraud in this situation, then, yes, evidence could be used to correct the fraud and/or protect the innocent party. Beyond that, if it is you needing to take action, or to defend against unfounded claims, then feel free to contact me if serious about getting legal help. No 'hint' or 'tip' here is of any value to you other than to confirm that remedy is available and then point you to a source of help.
