Legal Question in Civil Litigation in California

A pit bull was loose and attacked my dog who was on a leash brutally killing my dog. My dog was a show dog and to be used as a stud. I have a police report as well as a report with animal control and they have the pit bull. What is the maximum I can sue the negligent owner for having a vicious dog roaming around loose?

You can Sue for all damages including cost value of dog and loss of earnings.

I'm terribly sorry for your ordeal.

In addition to what Mr. Selik said, you can sue for the emotional distress caused by the loss of your pet and by witnessing the attack.

You will have the burden of proof on all of these issues. Nobody will expect you to precisely calculate the value of your emotional distress, but you will have to show how much your dog likely would have brought in in stud fees. That will require more than mere guesswork. You will have to show both that your dog was worthy of stud fees and that you would have put him to work that way. You will also have to show how much his fee would be and how many times you would have bred him over his expected lifespan. That means you will have to show what that lifespan is, establish what the prevailing fees are for your type of dog, and show whether those fees (and/or his ability to mate) would decline over time.

In short, you would need expert testimony. Perhaps you are qualified to give that testimony yourself. If not, you will need to hire one or more experts.
