Legal Question in Civil Litigation in California

Who is responsible?

My car was vandelized while it was at the

shop over night. The owner told me he doesnt

have that type of insuramce. All I wanted

was the $240 for my deductable. Owner doesnt

feel he should pay it. He sugested that we

split it. I think not. We made arrangement

to fix the car for free, but our times never

met. This went on for weeks. Still I had n

car. That is when I treaded it in and went to

collect my $240. To no avail....

Re: Who is responsible?

What you have is a bailment. The shop owner must use reasonable

care to protect you vehicle. You have not provided

me enough information to make a determination if reasonable care was used.

File in small claims for your $240 deductable.

Good Luck
