Legal Question in Civil Litigation in California

Thrid party lawsuit - non payment of debt.

I was employeed as the construction manager.

I was not a corporation member. I signed a rental agreement to guarentee payment to get our company a rental source for emergency Federal Government projects. I also filled out the credit apllication for the company as advised by the corprate office to get things going. They gave me the company account information to submitt for credit approval. I signed the document knowing it would probably be rejected. They did't reject it.

I was terminated in October 1997. Come to find out they were not paying there bills to more than just the Rental Company.

The projects were bonded and insured they were federal government construction projects.

After my termination the company has performed on project below average. And is being considered for termination on several of the projects that were awarded.

I was named as a third party in this suit for payment of the $77,000 dollar debt + fees.

I think I might be on the hook for the debt becuase the rental company rented to us.

I do not have the funds to fight this action due to my forclusure and recent banckruptcy.

I am looking for the best way out.

I was served last Friday 1/8/99.

You are not liable for this type of debt but if you dont get a lawyer and answer the complaint you are going to get screwed. I defend a lot of these kind of cases at a pretty low cost.
