Legal Question in Civil Litigation in California

Vehicle Repossession

In California, 2-1/2 yrs ago, my ex-boyfriend financed a vehicle for me. Two weeks ago it was repossessed due to him filing Chapter 7 and including the loan on my vehicle. Can I sue him for the costs of getting my personal items from the impound yard and the rental car and the down payment of my new vehicle? Also can I sue him because the repossession showed up on my credit report? I did not sign any finance papers, they were all in his name..I was only on the title of the vehicle. I now live in Texas and he lives in Arizona.

Re: Vehicle Repossession

Who exactly financed the purchase? That is who you need to go after about listing the bankruptcy. I would dispute with the three credit reporting agencies as well as whoeever financed you. The same people/company are responsible for your personal possessions in the car. When you say financed for you, was your name on the car? If your name was not on the car, your only remedy is against the ex-boyfriend for your personal possessions. If you were not on the paperwork, however, you may have a claim against the finance company or credit reporting agencies if they do not fix it after you make a written dispute.
