Legal Question in Civil Litigation in California

Work Product

Is the "Intake Form" taken by personnel manning a Legal Aid Hotline considered "Work Product"? In other words, if I ask the Legal Aid lawyer to turn over my files to me, is the lawyer also obligated to give me the "Intake Form" which also contains his comments/suggestions about my situation that I was calling the Hotline about?

Re: Work Product

Under those circumstances, I think it probably would be considered work product and they do not have to turn over to you. Not all work product can be kept from the client. If you had a situation where you paid an attorney to do legal research, the result of the research would also be work product but he would still be entitled to it because you paid for it.
