Legal Question in Immigration Law in California

I 130 form

Me (dutch) and my fiance (american) are getting married May 31st. I would like to know if he is able to file for the I 130 already, since I heard it takes so long?

My 2nd question:

I am here on a F 1 visa which experience June 6th. Am I able to stay or do I have to wait in my own country until these forms are completed?

As soon as you get married...I130 can be applied. You need to wait here while I130 and adjustment application is being processed.
