Legal Question in Immigration Law in California

Divorce during I485 processing

My husband (soon to be ex) has an I485 processing based upon his marriage to me (a US citizen) What are the implications of divorce? Will the processing stop? Will he lose his previous status and what will my responsibilities be after the divorce regarding the I131, and support documentation?

Re: Divorce during I485 processing

If you file for divorce before the I-485 is approved the application will be denied. On the otherhand, if you file after he gets his conditional grrencard...he can apply for removal of condition by himself showing that he had a bonafide good faith marraige.

Divorce before approval of the I-485 would revoke the entire application.

Re: Divorce during I485 processing

If a marriage dissolution petition is filed before your husband's I-485 gets approved (in other words a conditional green card is issued), then most likely his family-based I-485 might be denied because the marriage is gone.
