Legal Question in Immigration Law in California

245i change of employer

DEar Sir or Madam,

I entered the country as a tourist but since overstayed. An employer petitioned me through the 245i. My papers was now in the State DOL. I now want to change employer. Will I have to start the whole process again? Or will the petition continue in its present state?

Thank you for all kinds of advices.

Sincerely,

Re: 245i change of employer

Absolutely. You will need to start the whole process over again with a new employer, unless the new employer is a successor and bought out the old employer (unlikely). Obviously, I'm assuming that you're correct that you will qualify under section 245i (the old employer filed the ETA-750 before April 30, 2001).
