Legal Question in Immigration Law in California

I am trying to bring my Aunt from Peru, South America to the U.S. (California) on a temporary visa to help care for my infant. What information do I need and what things can I do to help get her visa approved?

You will likely need to apply online for consular processing of a visitor visa. How long would the stay be? We can arrange for this since it needs to be done online for most consulates.

What is your status? Does your aunt have any children in the U.S.? These and other questions will need to be addressed in order to help her obtain a temporary visa to come here. The primary questions will involve what your aunt's intent is (even if she declares she has none) to stay here permanently. Also, documenting her ties to Peru (as required under the law and Department of State guidance) will be essential.

She can apply for a temporary non-immigrant Visitor's visa only. On this visa, she can stay up to 6 months, with one possible extension fo additional 6 months.

Form your side, she doesn't need much documents.

On her side, she'll need to complete a visa application (which is done online), pay a visa fee and submit evidence of her ties to Peru and intent to return there after her temporary trip to USA.

You cannot bring her to USA as a long-term live-in nanny.
