Legal Question in Immigration Law in California

How can my Chinese pregnant wife get marital status?

I recently married a Chinese lady that was here on a

H1B1 status. Sense marring me she now has no status

at all. I am self employeed and have not generated any income sense 1995, but I have been living on borrowed money for my business. (Which is now generating income ;-)

I have submited all the needed documents to the INS as per their request, but have not heard back from them at all. This is causing a big problem because my wife is now pregnant and would like to go to see her parents in China before 5 months pregnancy and becoming unable to fly safely.

Is there anything that I can do legally so that she can obtain some status here in the US?

As is stands, if she leaves the country, the INS will not allow her to return. ;-(

Also, she would like to go back to work but is unable to obtain even a working status visa. What on earth can I do?

Thank you in advance.

Paul

Re: How can my Chinese pregnant wife get marital status?

Dear Paul:

There are just too many issues to cover and it would not be fair to you for me to respond without knowing all the facts. For that reason, I would like to schedule a consultation to discuss your immigration concerns with you in more detail. If you live in the Bay Area, I would like for you to come in, otherwise, please schedule a telephone consultation with me.

I look forward to receiving your reply.

Very truly yours,

The best way to get information quickly from INS is to personally visiting your local INS and asking for the status of your application. Written inquiries usually go unresponded for long period of time.

As for your wife going to China, that's a big NO at this stage of her case.

Try to get the info from INS, if unsuccessful, then hire a lawyer.
