Legal Question in Immigration Law in California

When can my dad?

My dad is 72 years old and had the green card for about 4 years and 3 months. Does he have to wait for exactly 5 years to start the process for citizinship? OR can he file few months earlier?

Thank you in advance.

Re: When can my dad?

Your dad can file his naturalization application as early as 90 days before the fifth anniversary of the grant of permanent resident stats (assuming he meets all the other requirements).

Re: When can my dad?

By law, a person may file a naturalization application 90 days early. In your case your dad can file an application for naturalization up to 90 days before he meets the continuous residency requirement. However, the five year requirement must be fulfiled before the grant of citizenship.

They may be other things to consider before filing for naturalization. My office handles this kind of cases and you may call the office at this number - 714-832-8144

Re: When can my dad?

Your dad does not have to wait for 5years to start the process.Yes, he can start the process a few months earlier. The rules is that, he can start the process 90days before his 5th year on the green card. Although, there are other issues that must be considered before he files so as to ensure his petition can be approved. If you need more information, contact my office by e-mail, phone or fill out a client contact information from our firm's website: http://www.omolaws.com.
