Legal Question in Immigration Law in California

hi my father filed form i-130 for a immediate relative of us citizen for unmarried child under 21. im now 21 but still in the under 21 catergory. he isnt on my birth certificate because he wasnt in mexico to register his name and never went back. the uscis ordered us to get a dna test which we went to go do it. and we just found out that he is not my biological father. how would he still be able to continue in getting my residency. and for the petition to not get denied?

You need to find out the details of your connection with the man you thought was your biological father. For example, did he file adoption papers for you, did you live with him as a minor child and other similiar information. Normally the petition is revoked with the death of the petitioner but there are certain remdies that depend on the facts of your situation. Please see an immigration attorney and bring all the noted information your can find along with the immigration paper work if you have it. Call me at 562-984-2008 if you are interested in setting up an appointment. Good Luck, Bill Klein
