Legal Question in Immigration Law in California

My fiance is currently residing here in the u.s. and has been for 22 years. i am a u.s. citizen and he is an illegal immigrant. we plan to marry in two months. can i petition him for legal stay here in the u.s even if he is already residing in this country?

If he enterred the US with a visa, he can apply for green card even he overstayed. However, if that is not the case, he needs 245 (i) protection.
