What are the laws in regards to someone hear on a marriage visa? I have a friend that has been married for 3 1/2 years and wants to file for a divorce. An imigration lawyer told him to wait a couple of months to receive his permanent green card in the mail. What are the laws as far as getting a GC when you are in an unhappy marriage? What is the time limit you have to be married? I cant believe we all the marriages that end in 2 - 3 years that he doesnt have another way to stay in the country through work or something else.

Generally speaking, your friend should be able to divorce and still obtain their permanent green card as long as the marriage was not fraudulent.

The standard is whether there was marital intention when they entered the marriage.
