Legal Question in Immigration Law in California

if i'm married and i''m a citizen of the united states, but my husband is not a legal resident i want to apply for his residency, but in the past he had a car accident and never went back to court nor payed any money can it be possible for him to obtain residency.

It may be possible, depending on his situation and the way in which he entered the U.S. If he innitially legallyentered the U.S. with a visa, passport, etc., then it's possible that you as a U.S. Citizen could file for him and he could adjust his status to a legal permanent resident. I would need to see what kind of criminal violations, etc. or convictions there were to let you know if these would impede his ability to obtain legal status in the U.S. If he entered the U.S. without inspection (no documents--EWI), then it may not be possible to adjust his status now through filing with the USCIS. Under the statute, he would qualify as the spouse of a U.S. citizen, but there is also some discretion involved in these cases - whether by adjustment of status or consular processing. Depending on more detail of the consequences of what he did were known, I could determine whether this is an issue or not.
