You may be better off marrying outside the US and then bringing her in based on your green card. Immigration law is very fact specific and it is unwise to give suggestions or advice without knowing the important facts. We have one attorney licensed in the US and Mexico who does most of our non-litigation immigration work. She charges for a consultation but you'd have answers you can rely on from a licensed and insured attorney, and the consultation if free if we work on your case.

Re: Marrying on a tourist visa

Not just like that. It would assume she could qualify to visit, meaning she has intention to return to her home country upon her application for the visa and arrival in the U.S. Even if she were to visit, and if you were at some future point to marry with you as a green card holder, in order for her to remain in the U.S., you would have to become a US citizen to make her eligible to adjust status in the U.S. She could be illegal in the meantime and if things didn't work out between you, she could have problems as a result of that in terms of what she could do while in the U.S. as well as returning here.

It's better to explore options other than through you, or you could have a longer timeline or I could advise also about other alternatives if you qualify or soon will qualify for US citizenship. I'm available for that sort of consultation. You can email me at [email protected], or do a consultation request on my website at www.yardum-hunter.com.

Re: Marrying on a tourist visa

Well, if you are only a lawful permanent resident, and petition for your fiance after she becomes your wife, she will have to wait quite a long time before being able to adjust her status to lpr. Are you intending on getting your citizenship? Your chances would be much better.

How many years you still have to be a citizen? Try to bring her in the USA on other non-immigrant visas. Then she can wait here legally to be adjusted while you become US Citizen.
