Legal Question in Immigration Law in California

What happens to the petition if the U. S. citizen is retired abroad and has medical condition when the visa is available for his son? Does he need to go back to U. S. soil to prove he is domicile and can file for affidavit of support?

Yes, the petitioner and sponsor has to be domiciled in the USA.
