Legal Question in Insurance Law in California

Looking for a bad faith insurance law attorney. Broker caused me to have two cancelled insurance policies with two different companies, when he was paid. Never paid the companies the difference as he agreed upon with me. Found out business has been suspended through the State. Wrote policies without my signatures or paperwork. Caused me to drive without insurance unknowingly and unwillfully. Sent demand for payment later which was returned with no forwarding address.

Sent complaint to State Department of Insurance. Advised to sue by attorney, please help!

First this sounds more like a breach of a fiduciary duty and possibly a fraud case but I don't see bad faith. You will have to hire and investigator to locate this broker because this person sounds like he just took the money and ran. If the carrier(s) the the broker was associated with knew of the broker's conduct I still have a hard time seeing how they acted in bad faith asn they never had a first party relationship with you since no policy was ever issued to you do to the misconduct of the broker, and I have been an expert witness. You should seek the advise of an attorney and IF you find that broker then sue (but THEN you must be able to SERVE this broker). It sounds like this person is a real flake who may not stick around too long. I hope this helps. Bob

I agree with Mr. Worth that this does not sound like an insurance bad faith case but does sound like you have a case. If you would like to make an appointment for a consultation in my Walnut Creek office please give me a call or send an email.
