My Car Was Damaged in an Accident..The insurance is avoiding me

My car was hit while parked in front of my home by a neighbor. The neighbor was the registered owner and her live in boyfriend (who i have seen drive the truck before) was driving. After he wrecked into my car he went back home, parked the truck and fled the scene. The police could not locate him. Can i sue the registered owner in small claims court for the damages (1,310.00)? I contacted her insurance company and they told me they had cancelled her because her grace period expired 3 days prior. Am i suing the right person? I can't locate the drive and neither can the police! Thank You

Yes, you can sue the owner. You can also make a

claim under your own vehicle coverage.

You should have the owner's insurer send you copies

of the notices to her, or at least put in writing

what you were told on the phone.
