Denial of Health Insurance

Four and a half years ago my daughter had a drug problem. However, she's been clean for over four years now. I've had to take her off my company health insurance because she's twenty one. She tried to get her own plan through Cal Farm and she heard today she was turned down because of the drug problem. Do they have the right to do this? What kind of recourse do we have - I really want to fight this.

Re: Denial of Health Insurance

First write the insurer and request a detailed

explanation - in writing - of the reasons for

such denial. Your daughter has to do this - not

you. Then see what happened. Tell the insurer

you want the information pursuant to California

Insurance Code Sec. 791.08. You should read

section 791 et seq.

Go to the next step after that. Also, if she has

a good agent/broker, discuss this with him/her

and look into other - group - insurance.
