Legal Question in Employment Law in California

Accusations

There is a female at my work that has gone to HR to complain that I am spreading rumors about her and I being intimate boyfriend girlfriend, etc. This is completely untrue. The HR department has not approached me with this yet but talked to someone else and asked them if they knew anything about it. My question is this, if I do get called into HR what do I say? We have been intimate before but I have not told anyone about this and never would. Can they just go on her word and discipline me? I have done nothing wrong at work and now it seems as though she is trying to get me fired. BTW she was recently diagnosed as bipolar, has OCD and has a nervous breakdown.

TIA.

Re: Accusations

Thank you for your inquiry.

If you are called into HR, you should tell the truth. You've stated that you didn't do anything with this person, and if so, you should state that.

You may have certain other rights IF the company takes action against you based upon this unproven allegation, but that would be premature at this time based upon what you've described.

I hope that this information helps, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. I am happy to help in any way that I can.
