Legal Question in Employment Law in California

I have an active workers comp case going on. I was put on modified duty, no lifting of 10 pounds or more. I never missed any work while this has been going on.

I was laid off last week due to a company restructure. I was told my position was eliminated. I know for a fact they have other Reps absorbing my duties. Does this company still have to cover my workers comp case even after a lay off?

The company is asking me to sign a "General Release Agreement" the verbiage is somewhat vague they list various things under this Agreement.

The concern I have is if I sign this will I be losing my rights for my workmans comp case. Also, the only way I can get my severance is by signing this release.

Thank you

No, your worker's compensation case is not eliminated. In Fact, if the insurance company were paying you temporary disability benefits, they have to continue doing so. Feel free to call us at 213.388.7070 for a free consultation.
