Legal Question in Employment Law in California

I belong to a union. We have been negotiating with our employer and finally hvae come up with a draft of the final contract. The employer have signed the MOU/contract but our union have not signed it. Are the terms of the contract in effect or is it only in effect once our union signs it?

I was told that the employers are held by the terms of the agreement even if the union have not signed it. The person who told me this stated the California Civ. Code 1624 [Statute of Frauds] as the basis.

Can you please let me know?

As a union covered employee, your rights are ONLY what the MOA or CBA provide, in or out of contract term, unless the union is kicked out of the company, not likely. Talk to your union rep, no one else can help you.
