Benefits for opposite sex domestic partners?

I work at the California branch of a NYC-based business. My employer recently began offering *same-sex* domestic partner benefits, but will not offer opposite-sex domestic partner benefits. This seems somewhat unfair--is it in accordance with the law?

California law requires that there be no discrimination because of sexual orientation. Because same sex couples are unable to marry in California, the legislature and governor have required businesses to afford benefits to domestic partners as they do to married opposite-sex couples. The legislators concluded that unmarried opposite-sex couples have a choice about marriage, but same-sex couples do not.
