Charged with a felony

I know an employer can ask if I've been ''convicted'' of a felony. But can they also ask if I have been ''charged'' with a felony OR if I have been the subject of any civil litigation?

I advise my clients to inquire whether any charges are currently pending against the applicant. Being charged or convicted of a felony is not a protected status. Employer's can use that information as part of the decision making process.
