Legal Question in Employment Law in California

My former employer owes me back pay and reimbersments on receipts that add up to around $12,000. I know for a fact that she has no money, no business assets, nothing. If she files the company banckrupt will she still have to re pay me. She had a buisness partner that has now dumped her. Will they go after his other company? Need to know what steps to take.

If she has no money, what do you think she is going to pay with? You could and should file a claim with the Labor Commissioner for unpaid wages. If she files BK, then you can file a Claim with the BK court for the wages; you would have a priority over other creditors.
