Legal Question in Employment Law in California

Can an hourly employee be forced to work 8 hours daily and if they do not then their vacation and/or sick pay is used to make up the difference.

What is the normal work shift for your employment? In most companies it is 8 hours per day for 5 days a week. Your sick leave and vacation can not be reduced but if you are not working a full shift when hired to do so you can be fired.

No. If the employer is improperly crediting or deducting accrued sick and leave time, then you have a claim to make with the Labor Commissioner. If serious about pursuing it, contact me to discuss.
