Legal Question in Employment Law in California

Internal Negative Referral After Resignation

I had requested a transfer from Maryland to California

for family medical reasons and was denied. I was

forced to resign to be with my wife and children. After

submitting my notice of intent to resign (6 weeks notice

given), I informed my boss that I would seek to stay with

the company by contacting the appropriate person in

California. He said he would see if there was anything

he could do to help.

I worked the length of my notice, moved to California,

and contacted the appropriate person within the

company. At our meeting, he was frank and told me that

my former boss had ''nothing good to say about me'',

despite the fact that I have numerous emails from my

former boss lauding my performance. My prospects for

staying with the company are slim based on his

negative referral. Is there any recourse?

Re: Internal Negative Referral After Resignation

It depends on what your boss said. Statements of opinion are privileged and not actionable. False statements of fact may be defamatory. More information is needed.
