paycheck deduction

My husband went over the 200 min. allowance for his use of the company cell phone. The company is now deducting the amount in full for each month he went over, out of each paycheck he receives. He verbally agreed to this, but has not yet received any bill/statement. Is this lawful and are they required to offer a payment plan instead of taking the amount out in full.

Re: paycheck deduction

Unless he agreed in writing for the employer to deduct such overages from his paycheck, it is unlawful for the employer to do so.
