Legal Question in Employment Law in California

racial harassment

I have had a co-worker asking people how much can I get on auctin block for this boy? Also this person has refer to me as boy in while teaching classes. He has used these types of remarks in front of our supervisor who said nothing to correct this type of behavioral. My company has said they are investigating but after 3 months nothing has change. At our chrismas party this co-worker was still refering to me as boy. What should I do to stop this harassment because it is clear that my company has not address this problem serious?

Re: racial harassment

You may have an action for harassment under Title VII of the Civil Rights Act of 1964 or the California Fair Employment and Housing Act. You should file an internal grievance or complaint with the employer and if that does not work, contact the EEOC or the California Fair Employment and Housing Office. Since a supervisor knew of the harassment and has failed to stop it, you may have an action for discrimination against the employer.
