Legal Question in Employment Law in California

Recent college grad took employment as an independent contractor with small lucrative start up company. I recently discovered my employer has closed deals based on my "reasonable efforts" and has not notified me or offers payment. I have been with the company 4 months and have �it made a single dime, however the total revenue generated has been more the. $900k. I also discovered there may be an IRS fraud issue at play. How can I demand immediate payment and terminate my contract with them? I don't want to work for dishonest people but student loan payments and rent are due!

The first issue that must be determined is whether you were misclassified as an independent contractor. Many companies, especially small or start ups tend to make this mistake, and there can be serious penalties for having done so, not to mention wages that should have been made to you.

Secondarily, you may have a breach of contract issue with this business. You should have an attorney review the contract you have with this employer to determine what your rights and remedies are.
