Legal Question in Employment Law in California

retaliation

After about a year of harassment and discrimination.By way of pay-shortages,written-disciplines,and being the only person at my job getting disciplined while the female employees are alowed to do as they please.I wrote a letter to my terminal manager complaining of harassment and discrimination. And requested a meeting with management and my Union. This was Jan.15,2004.I also called our human resource department wanting to file a complaint on management.Jan 16,2004 Im called by phone and told Ive been suspended but not told why!Jan,19 Im told to come back to work but on a different shift.Jan,23 Im pulled of job and told Ive been kicked off the property by our customer.Which turned out to be a lie. Then Jan 30 Im called back for a meeting and terminated for harassment allegations.I proved my through grievance procedure that this wasnt true and got my job back but lost 9,000.00 in pay.Is this retaliation?I have the D.F.E.H investigating. Also do I have defamation by coworker for false harassment claims?

Re: retaliation

An employer cannot treat you in a punitive manner because you complained about harrassment. I'd try to hook the employer in on any other tort by co-workers also. Call me directly at (619) 222-3504.
