Legal Question in Employment Law in California

screwed out of a promotion

I have been employeed in the public sector for 35 years and at this paticular job for 7yrs. Because the chief and I have been at odds over numerous things (not just me but many other personal also)he decided to go outside the agency for a supervisors position. He & his boss end up hiring an old friend of his from the 60's (they deni this friendship). This new guy has not been in the profession for over 23 years and doesn't have a clue whats going on and has done nothing to better the dept. etc.. He has openly tried to get all of us to leave and seek employment elsewhere. He has tried writing me up but it went no where after I submitted a 5 page rebuttle. We have caught him lying numerous times about a variety of things. Our contract states that the dept. will hire from within unless there is an outside person that is demonsersley superior. My ? is do I have a case against them for going outside the dept. I have nothing but good/great evaluations since employeed there and have been doing the supervisors job for the past 6 years. I have (and they do also) a written letter of support from all the dept. employees. What's my choices?? thanks much please reply by e-mail to [email protected]

Since it sounds like you have a Union contract governing your workplace, you will need to file a grievance under the contract to make your claim.
