Small claims/labor

My employer expects me to work over time whenever he thinks of it, without notice or asking. Also, i have not recieved m pay since December 2006. I cannot afford a lawer to sue. Can i file a labor suit in small claims court assuming the money owed is under $5000US?

You can file a small claims lawsuit for unpaid wages, but the new limit for individuals is $7500. You can also file a claim with the Labor Board, which might be a little less intimidating than small claims court.

If you've worked and haven't been paid, the State Labor Board (EDD) could handle your matter without cost to you. Penalties also attach because of failure to pay. If you're also claiming unpaid overtime, make sure that you present a calendar with your overtime hours.
