Legal Question in Employment Law in California

termination & severance

Was given a performance improvement memo in late April, with required revenue results expected for May & June. I was Assoc. Publisher running the paper.

Then after voicing a complaint on behalf of several clients & their issues on not receiving invoices, I was terminated via email. Only paid thru that week ending 6/5/09. Now she has offered severance through June (after I raised the question) once I sign a severance agreement. It would seem to me that pay thru June should have been in lieu of notice pay versus severance. Plus her termination was ''retaliatory'' because I complained about our invoicing problems. Suggestions

Re: termination & severance

Suggestions? Negotiate the best deal you can get. Without a written contract, you're an at will employee that can be fired any time for any reason - right, wrong, or otherwise. This isn't 'illegal retaliation', it's office politics and personalities that go along with the job. If you are a highly compensated individual, it may make sense to have counsel negotiate on your behalf to improve the offer. If serious about doing so, feel free to contact me.
