Legal Question in Employment Law in California

Unfair Business Practice

I work for a large public company that offers special treatment to high performing sales reps making it easier for them to sell and achieve higher commission rates. Special treatment includes larger territories, and over 40% more sales leads. There are over 1000 reps in the firm. Do the reps who are not receiving special treatment have any legal recourse to force the company to offer a true, level the playing field?

Re: Unfair Business Practice

This almost seems obvious but why shouldn't an employer treat the more productive employees better? This serves as an incentive to be more productive, doesn't it?

Naturally, employers cannot discriminate based on such factors as age, race, sex, religion and many other reasons. But that does not sound like what is happening here. If you think there are improper motives for the favoritism, other than what you've mentioned, consult with an employment law attorney for a more thorough evaluation.
