If you feel you are not properly paid, you can file a claim with the Labor Commissioner, or file a civil lawsuit if the amount in question is enough. Your legal status is not an issue with them. You are entitled to hire an attorney to help you, and I recommend that for you. If you win your case, you are entitled to unpaid compensation, interest, penalties and your attorney fees. If serious about doing so, feel free to contact me.
