Legal Question in Employment Law in California

I work at a group home with people with developmental disabilities, one of the consumers got upset, he assaulted me, however, he did no harm to myself, he did damaged my car door by kicking it in on several ocassiones, leaving me a $ 1250 dollar repair bill.

I was working at the timw of the incident, my car was parked in front of the group home, using a city parking permit assigned to the group home, since it is by permit parking only, a police report was filed, and I personaly did see the consumer damage my car.

Who should pay me?.

The Disabeled Individual from the Group Home?

Or the House Owner, since it was a damaged done by one of her consumers, while I was working, and the damaged was caused due to a work related incident?.

They are both liable to you for the damage if it was as a result of doing your job or while in the course of your job. However, realistically, your employer is the only one who is going to be able to pay for it.
