Legal Question in Employment Law in California

I work for an Indian Tribe in CA and they are a Soverign Nation. I signed a consent form before I was hired to subject myself to a background check. Everything turned out fine; I was hired. Almost a year later, I found out that the HR Dept. ran subsequent background checks on every employee without any consent from employees.

How can this be legal?

Legal? You gave consent. I'd bet the form allows periodic checks. If this is a casino, such checks would be standard policy and required by the Gaming Commission.
