Wrongful termination due to budget cuts

My husband is an Athletic Director at a Community College. He was given a pink slip on March 15th and was told that his position was being eliminated due to budget cuts. The end of his contract is June 30th of 2003. He is working to finish out his contract and the college has moved a Dean of Student Services over to fill my husband's position. Now the Dean is doing the EXACT same job as the Athletic Director instead of overseeing Student Services. My husband has never been reprimanded nor written up. He has a ''perfect'' record with the institution. My husband would have received tenure on July 1st, 2003. Can they eliminate his position due to budget cuts and have another person take the position?
