Legal Question in Landlord & Tenant Law in California

60 day notice

I was served with a sixty day notice because the landlord sold her house and wanted to move in. Do I still have to pay the rent for this sixty days. Thank you in advance.

Re: 60 day notice

Yes, you owe rent for any thime you are there.

She can only give you a 60 day notice if you are on a month to month agreement. If you are on a lease that expires on a specific date, she cannot force you to move until that date.

Re: 60 day notice

Howdy:

Ken's right. But, even if the lease expires on a specific date, most agreements still require notice be given. So, if your lease is still in term and expires in the next 60 days, the notice is sufficient.

Of course, if you don't want to pay, she may let you leave early.

And, if your lease is month to month, you can end the lease with a 30 day notice ... and get out by May 1. (Yes, you'd still have to pay for April!)
