Airplane hanger lease

Our hanger lease ends June'09.

Sold plane, landlord leased our hanger Jan 1'09. Now wants us to pay $350 per month while he also

gets $450 from new pilot. Lease

states $75. for any unused months.

Can he double dip & change from $75 to $350 per month? Only the $75 in is the contract. The $350 is verbal only in the last few days.

Does Calif law allow him to charge

2 tenants at the same time?

He does not have the right to charge 2 tenants at the same time. I not sure that he can charge the $75 either. A landlord has a duty to mitigate his damages, meaning he must make every reasonable effort to relet the space. You should consult an attorney and let him review your agreement.
