We have had a therapy dog for my son which my landlord has known about for the past 5 1/2 months and now they are giving us a 3 day notice to remove the dog or forfeit the apartment. Is this legal?

Probably not, although the landlord could likely charge an additional sum for the dog being there as it adds to the wear and tear on the apratment. Contact the landlord immediately and ask why the change in attitude now. Having known about the dog for 5.5 months he may be estopped from raising the argument at this late of a date. Also, the dog might come under various regulations protecting people with handicaps. check wlith your local organization that helps disabled people. Also, if your city is covered by a vacancy decontrol program there is a limit on what you can be evicted for.

The last tactic would be a letter form an attorney pointed out all the legal problem the landlord will have in evicting you, the costs he will have, and the amount of time it takes for an eviction. Some attorneys might write such a letter for a few hundred dollars.
