Eviction Process

Can I ask for a continuance at a trial for Unlawful detainer if my witness isn't present? Also, can I let the judge know I wasn't given a copy of the complaint with the summons when he served me? Do you think I would have a good chance to win my case based on that? On the 3 day notice the amount wasn't broken into months it only had I owed $1550 from April to June is that legal?

Help please!!!

You'd better be careful. Judges don't like when tenants are not prepared for trial. If your witness can't make it, you may not get a continuance. If you do, if may only be for a day or so.

As to chances of winning your case, if you didn't pay rent within the three-day period, you're in bad shape, unless you have some legitimate excuse besides not having the money. It's a tough situation. YOu can try your defenses, but they're not that good. Best of luck.
