As a homeowner, in a state that has legalized the recreational use of marijuana, am I potentially liable if my tenant is growing (and possibly selling ) marijuana outside the legal limits? Am I obligated to report this activity to the police or Is it enough to demand that they cease within a set time limit like a 3 day notice to quit?
You are at risk of forfeiting your property without even a hearing under federal law if you know about this and allow it at all. The state law does not protect you. I'd give the tenant 4 hours to get it completely cleared out or you'll call the police and the file a complaint with the U.S. Attorney's Office.
