Legal Question in Landlord & Tenant Law in California

Are leasers and sub-leasers subject to the same laws as tenant and landlords? In other words if a leaser does not submit a list of damages within 21 days after the move out day or return the deposit does he still forfeit the right to charge for damages like a landlord would?
