Mice

Is the landlord reponsible to get rid of the mice, he said I am the first tenant in this rental house to have them

Yes!

Call your local health inspector and/or building inspector (look in city or county government white pages) and they will visit and make report.

Notify landlord by certified letter that he has seven days to get rid of the mice.

There are lots of other options, too numerous to mention, from breaking lease, hiring exterminators yourself and deducting from rent, withhold rent, suing for damages, etc.

California Civil Code section 1941 requires a Landlord to keep a dwelling in “tenable” condition.

California Civil Code section 1941.1 specifies that a dwelling is rendered “untenable” if the landlord fails to keep it free of “rodents and vermin.”
