Remove someone from your home

My father allowed his wife�s son to come and stay with them for three months in December 2008 and we are trying to find out what we need to do to remove him from the house. He has never paid rent and he was to leave in April. My father and his wife are now going through a divorce and his stepson has not been in the home for over two weeks. Please let me know what we will need to do to get him and the remainder of his things out of the home legally. Her son is a drug adict and has already stolen money out of my father's account I don't want things to get worse.

An unlawful detainer action is required with the notices provided under law. Is the premises leased or owned by both husband and wife? Is the wife in agreement? How old is the step-son? Contact me directly.
