I am a renter, and rented a room to another person. We had a simple written agreement, which stated that either party had to give a 30 day notice. She moved in dec 26 o4, paid her last month rent on july 25 o5, gave a 30 day notice on aug3. 05 and moved out all her possesion and returned keys on aug 5th 05. Am I obligated to return any of the rent she paid for the month of aug?She knew that she didnt have to be out till aug 26th 05. but she chose to move early. She has not asked for any money, but I want to make sure I do not legally owe her any of the remaining rent. She also gave me a $200 deposit when she moved in, but I am holding that for damages that occured on her behalf, and she skipped out on her last month of her share of utility bill. Can I move anyone else in, before 8-26-05 and I would also like to state I was the only person on the lease.

I hope I gave enough info, I appreciate your help. since I am disabled I can not afford an atty. I could not get help through legal aid, or fair housing, they say I over qualify? so i appreciate all you can do for me. thanks

If your tenant paid rent through August 26 and moved out early, you should pro-rate her a refund for 21 days. You may deduct from her deposit the cost of any damages she caused and her share of the utilities. You may also move in another tenant now or whenever you like.
